Terms of use

These terms cover MarineOS on helm displays, iPhone, iPad and Mac, and MarineOS Cloud at marineos.cloud (together, "MarineOS"), provided by MarineOS ("we"). By using MarineOS or creating an account you agree to them.

Not certified navigation equipment

MarineOS is an aid to navigation, not a replacement for official charts, certified equipment, a proper lookout or good seamanship. The skipper is always responsible for the safe navigation of the boat.

Your account

Keep your sign-in details safe; you're responsible for what's done with your account. Only pair boats and devices you're entitled to, and only invite people you want to see your boats. You must be old enough to agree to these terms where you live (and at least 13).

Your content

Your routes, waypoints, tracks and boat data stay yours. You give us permission to store, process and show them only as needed to run MarineOS for you and the people you share an account with. Our privacy policy explains how.

Acceptable use

Don't misuse MarineOS: no attempts to break or overload it, to get at other people's accounts or boats, to scrape or resell its chart data or services, or to use it against the law. We may suspend accounts that do.

Charts, data and open source

Chart and map data come from public sources under their own licences, including OpenStreetMap (© OpenStreetMap contributors, ODbL). MarineOS includes open-source software under its licences; see the chart viewer licences.

Software updates and changes

We improve MarineOS often. Helm displays can update from MarineOS Cloud, and the apps through Apple's App Store. Features may change or be withdrawn, and features marked "coming soon" aren't promised by a date. If we make a change to these terms that matters, we'll tell you before it takes effect.

Prices, licenses and subscriptions

The MarineOS apps for iPhone and iPad, the web chart and MarineOS Cloud's free plan cost nothing. What's paid for, and what it includes, is on the pricing page; payments are taken by Stripe.

Helm licenses. The helm display software runs fully for a trial period. After it, without a license, a helm starts in Safety Mode, which keeps what's needed to navigate safely (the pricing page lists it); nothing is ever turned off during a trip. A license is bought once for a boat, covers up to the number of helm displays on that boat the pricing page says, and includes updates for the version of MarineOS it was bought for; safety fixes reach every helm. It doesn't expire, and a licensed helm works offline. A license is for one boat at a time: it goes with the boat to a new owner, and its owner may move it to another of their boats once a year. It may not be shared between boats.

Software updates. MarineOS Helm versions are numbered 1.0, 1.1, 2.0 and so on; maintenance releases of a version are numbered 1.0.1, 1.0.2. A Helm license includes the version current when it was bought and its maintenance releases (security, safety, reliability and compatibility fixes). Each version gets maintenance releases for at least 18 months after the next version is released, and critical safety and security fixes for at least 3 years. New versions come with Plus (and Fleet) while subscribed; the versions released while you were subscribed stay yours, with their maintenance releases. MarineOS never downgrades a helm or removes a feature it has because a subscription ended.

Plus and Fleet. These are yearly subscriptions that renew until you cancel them (in Plan and licenses, any time; they run to the end of the year paid for). Fleet includes Helm licenses for its boats while it's subscribed, and for a grace period after it ends.

Refunds. If a Helm license or a new subscription isn't right for you, ask within 14 days of paying for a refund. A refunded license stops counting.

Prices may change; a change never affects a license already bought, and a subscription's new price applies from its next renewal, after we've told you.

Ending

You can stop using MarineOS and delete your account at any time. We may end or suspend the service, or an account that breaks these terms; where we can, we'll give you notice and a chance to export your data.

No warranty and limited liability

MarineOS is provided "as is" and "as available", without warranties of any kind, including fitness for navigation or for any particular purpose, to the extent the law allows. To the extent the law allows, we aren't liable for indirect or consequential losses, or for loss or damage arising from navigation, collision, grounding, weather or reliance on MarineOS, and our total liability is limited to the amount you've paid us in the twelve months before the claim (if any). Nothing here limits rights you have that the law doesn't let us limit.
